This End User License Agreement (“EULA”) governs your access to and use of real estate listing information displayed on kurilla.com (the “Site”), operated by Kurilla Ltd. (“we,” “us,” or “our”). The listing data is provided through Broker Reciprocity/IDX from NorthstarMLS (“MLS Data”).
By accessing or using the Site or any MLS Data, you agree to be bound by this EULA. If you do not agree, do not access or use the Site or MLS Data.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to view the MLS Data solely for your personal, non-commercial use in evaluating real property for potential purchase or sale. This license complies with NorthstarMLS Broker Reciprocity rules and may be revoked at any time.
2. Ownership and Source
The MLS Data is sourced from NorthstarMLS and participating listing brokers. All MLS Data, including text, photos, and other content, is copyrighted and owned by NorthstarMLS, the listing brokers, and/or other third parties. We are authorized to display it but do not own or control it. All rights not expressly granted are reserved.
3. Permitted and Prohibited Uses
You may:
- View and search MLS Data on the Site for personal purposes.
- Print or save limited portions for your personal reference.
You may not:
- Copy, reproduce, distribute, modify, create derivative works from, or publicly display the MLS Data (except as allowed above).
- Use the MLS Data for commercial purposes, advertising, marketing, data mining, scraping, bulk extraction, appraising (beyond personal use), or any automated means.
- Use the MLS Data to solicit property owners or contact listing brokers without permission.
- Remove, alter, or obscure any copyright notices, trademarks, IDX logos, or attributions.
4. No Warranty / "As Is" Disclaimer
The MLS Data is provided “as is” without warranty of any kind. It is deemed reliable but not guaranteed accurate, complete, current, or error-free. Neither Kurilla Ltd., NorthstarMLS, nor any listing broker warrants the MLS Data's merchantability, fitness for any purpose, non-infringement, accuracy, or reliability. You use the MLS Data at your own risk. We are not responsible for any reliance on or decisions based on it.
5. Limitation of Liability
To the maximum extent permitted by law, Kurilla Ltd., NorthstarMLS, and the listing brokers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your access to, use of, or inability to use the Site or MLS Data—even if advised of the possibility of such damages.
6. Attribution and Compliance
Listings are displayed courtesy of their respective listing brokers and NorthstarMLS. Required attributions (e.g., “Listing courtesy of [Listing Broker], NorthstarMLS”) appear on detail pages as provided in the data feed. Broker logo and IDX disclaimers are included per NorthstarMLS Rule 12. All displays comply with Broker Reciprocity guidelines.
7. Changes to this EULA
We may update this EULA at any time. Continued use of the Site after changes constitutes acceptance. Check this page periodically for updates.
8. Termination
We may restrict or terminate access to the MLS Data or Site at any time, without notice, if you violate this EULA or NorthstarMLS rules.
9. Governing Law
This EULA is governed by the laws of the State of Minnesota, without regard to conflict of laws rules.
